I can tell you from personal
experience, that doing a Federal
Tort Claim by yourself against
the VA without any lawyer to represent
you has almost no chance at all
of succeeding. The judges themselves
are corrupt, and without anyone
representing you, they are as much
of a liar and falsification scammer
as any VA Adjudicator is. Liars
and scumbags is all that they are.
They especially hate Veterans.

Your case will get dismissed in
a New York Minute for virtually
no legitimate reason at all. They
will play you for a sucker and lead
you on all the way into the middle
of the case just so they can find
out what the details of your lawsuit
is then kick it out the door and
call their friends to tell them
the entire story you are peddling.

There are no cases on the Internet
where Veterans actually file TORTS by
themselves and then WIN !!

The SF-95 Form process can
take up to a year to even receive
a reply denial from the VA. Then you
have to decide if you are set up to file
in U.S. District Court on appeal after
you receive the denial, and for sure,
that is what you will get. If you
don't have a lot of travel money,
then don't even bother filing an
SF-95 Form for VA Tort Claims.

Keep in mind that the SF-95 Tort
Claims papers are filed with the
VA Office of General Counsel ----
the very same ones that you are
likely filing against in your
disability case. So they are not
your friend nor are they interested
in facts, the law, or even the
truth. They come into your case
putting on a Legal Defense on
behalf of the VA Secretary. So
you have to understand straight
up what an uphill battle it is to
do this which will cost you money
in xeroxing, postage, and tons of
reading to do at the local
law library with more grief and
frustration than you had ever
hoped to take on when you
started it all. Tort Claims are
NOT for the incredibly sick so
pass the whole idea right on by.

To that end, a few resources
have been located on the internet
to help you comprehend a lot better
just what will and will NOT be
fileable under an SF-95 Federal
Tort Claim against the VA.

To actually download the SF-95
federal form: http://www.usdoj.gov
and use the SEARCH feature to
find the form to print out at
that website. Yes, it's the Dept
of Justice.

There is a law firm in Florida
which only represents federal tort
claim cases in Florida -- we have
a lot of Veterans down there so
here is the LINK:
http://www.federal-tort-claims.com

Think your case through and write
out some notes before you go see
them so that you don't come across
all confused and nutty and scare
them off. But get representation
if you can pull off a deal with them.

The Federal Tort Claims Act is best
defined and discussed in meaning
and definition at the following
LINK: http://www.lectlaw.com/def/f071.htm
Scroll downward when you arrive
at this LINK page.

It is all spelled out for you
here, what the boundaries and meaning
are for Federal Tort cases. A shovel
full of reading, keep at it and
be studious and don't miss a single
word of what they say.

Also use Google searches for combined
word groups such as: lawyer tort claim
etc. Just rotate different search
terms and then explore the HITS
that you receive back.
