Question:
EASY! They DID IT!
I had the same thing happen to me with my service accident.
I was struck by a motorist on the base I was stationed at.(He was drunk and ran the stop sign being in a hurry to get home.)
It happened at approximately 4:30 pm, quiting time for most of the base personnel, hence everybody was in a rush to get home/off work.(The chap who struck me was a retired LTCdr who worked on base as a GSA employee, he's just come from a party celebrating his promotion to GS14 and was 3 sheets to the wind.)
Fortunately I was only 5 blocks from the base hospital and was picked up quickly by the ambulance.
Upon arriving at the hospital and being revived I had to give blood and urine. The urine came out black(blood) indicating internal injuries and bleeding. I was rushed to radiology and x-rayed from head to foot.(on the x-ray table for over 2 hours.)
Was determined that I had a punctured kidney as well as blunt force trauma to the back, neck and head as well as a crushed foot.
The broken bones were stabilized with casts and I was put in urology ward for treatment of the kidney.
After several days with no visit by a doctor to advise me of what surgery was planned for the various broken bones and getting nothing but the runaround by the nurses I crawled out into the hallway found a wheelchair and went down to ortho to see what was happening with my case.
Doctor was waiting on the x-rays which he'd requested several days before to decide the best course of surgery.
I went to radiology to get them for him and was told they HAD NO X-RAYS of me and no record of my ever having been in radiology.
I raised hell and got them to redo some of them.
They neglected to do my back, as a result nothing was ever done inregards to my back injuries and it took me 20 years to get the VA to admit that my back problem were service connected.
It wasn't until I'd got out of the hospital some time later and gotten a lawyer to sue the bastard that I began to put the whole picture together.
The retired double dipper who nearly killed me was golfing buddies with the CO of the base.(A rich ass annapolis prick who had a fortune to protect. House on St John's bay forty foot cabin cruiser on the bay etc...)
He'd had my x-rays and emergency admission records burned.(Could never get anyone at the hospital to testify or make a statement, cowards!)
To top it all off he snuck his lawyers on base the day after the accident, got them into the hospital and right after the nurse came into my room and had me sign the surgical release forms came in after her wearing a lab coat and told me he had some more forms for me to sign!
They were of course forms releasing him from any responsibility in my injury.(I was on hourly dosed of demerol injections. My foot was swollen bigger than a football and black. My back was swollen and black from my neck down to my buttocks. I was pissing out my blood faster than they could replace it, I had IV's in both arms. Needless to say I was in agony.
I was also practically blind as my eyeglasses were destroyed in the accident and my eyes had crossed from the trauma of the head impact.
I really wasn't coherent enough to sign anything.
Didn't stop this bastard from fking me over tho'.
I fought him for two years after I'd been cycled out for a settlement and all I got was 20,000.(I had to hire my own lawyers while he used JAG.)
The USN stepped in and took over 15,000 for recoop of medical expenses, I didn't even have enough left over to pay my lawyer.
I get nearly killed by a drunk driver on base and then wind up paying for my own hospital bills.
And to top it all of I didn't even get any kind of compensation from the VA until 1993 after fighting then for all those years.(It was only 10% a bit over 70 dollars then. after having payed lawyers all of what little life saving I'd managed to hold onto over the years to get to 10%. I'll never see black ink on this affair,I do see red quite often tho'.)
So don't be suprised, the bastards will do everything illegal they can to cheat you.
An old Republikan saying goes like this"You haven't done anything wrong if you don't get caught".(And with the system stacked against us how do we prove anything?)
Keep your shoulder to the wheel and stick with it.
I finally got 50% this past April.(Am still fighting for 100%. will probably die first.)
