2 civil rights cases have been filed
against the VA recently and are moving
through the review process. VA FORM 10-0381

These first cases are in my name
only with a 3rd still in development
under the name of the Fort McClellan
Veterans medical patient group. That
should be filed sometime next week.

While it's widely known that the
VA Office of General Counsel routinely
falsifies and dismisses Tort cases
taking advantage of his "sole signature
authority" without any other independent
review eyes involved, the Civil Rights
cases do have to pass through the
VA Secretary's desk into review from
the top down. A 2nd shadow copy of
the cases have also been filed at
the U.S. Dept. of Justice and I
am optimistic that this will short
circuit the charades and criminal
doings of the OGC well enough to
force a Justice Department intervention
into both reviews.

The first 2 cases are aimed at
prosecuting VA Rater Joseph Collorafi
at VARO Manhatten in New York for
falsifying ruling documents and
illegally blocking VA Form 9 Appeals
Forms to the BVA. My case was forcibly
intervened upon by the BVA back in
October and removed out of Manhatten's
hands. The evidence includes an
IRIS email confrontation I made
with him directly only to have him
attempt evasisive action to hide
and conceal what he had done by
trying to force a SECOND and unnecessary
VA Form 9 appeals form out of me
for no apparent reason other than
to hide his corruption and screwups.

I had the bearings to fetch and
retrieve the email exchange which
he will not be able to deny since
the IRIS environment is a secured
and somewhat anonymous environment
for the VA Raters themselves to
launch emails from.

The Fort McClellan case will be
posted in this Forum when it is
served.

Since the filing of these 2 cases,
the House Veterans Affairs Committee
has held a hearing on Claims Automation
(transcript and audio file posted
elsewhere on this Forum Page) and
that hearing involved the testimony
under oath of a former VA Claims
Supervisor out of Cleveland who
openly stated for the record that
Veterans are forced to absorb
and provide corrections and fixes
for the incompetencies and screwups
of the VA Raters. That audio file
is being retrieved and will also be
sent into the case record of the VA
civil rights cases.

REPLY TO KAZMAX:

I agree with you totally.

There are state and county VSO officers
listed in your phone directory. They are
more screened than the "non profit corporation"
operations. Look in the phone book under
your County name for Veterans Service
Agency or something like it, and look
under your state name for XX State Veterans
Affairs Division or something like it.

Both places do claims for veterans.

If your case is passing from the Board
of Veterans Appeals into the Court of
Veterans Appeals, then you can get a free
lawyer to represent you at the Veterans
Pro Bono Consortium in Washington DC.
www.vetsprobono.org I think is the
address for them.

Other than that, you are required by
law to pay full fees for a lawyer until
we can get the law Repealed at some
point.

Claims in New York State are a complete
mess just so you will know. VARO NYC
has undergone mass firings for case
trashing and falsification and neither
the Congress committees nor the new
VA Secretary has spoken on what is supposed
to be happening to the crime victims
for a rescue.

Good luck to you.

I need some advice and assistant with my case.
I had my hearing 15 Jan 09, prior to the hearing I told the worthless DAV rep. I did not want him to represent me. In the hearing he went against my new findings from my hosp stay
in Oct 08. I filed a complaint with the district
supervisor, in NY and DC, to no avail. I did not know the NSO had animosity towards me until the morning of. He had documented in his computer I had hung up on....
He told the judge he was recommending I be schedule for exams by the VA. This will be made public to the. The DAV are worthless B...
