My attorney has filed papers in US Fed. Court suing VA for near death experience with diabetes. File FORM 95 2 years ago, VA had 6 months to reply, they took nearly 2 years. If you have had a SERIOUS problem with VA ( malpractice/negligence ) you must first file a FORM 95, a 1 page Form notifying them you are suing them. Make sure you submit a statement with the FORM, try to keep it short & on the mark. Will let all know outcome.
UPDATE: FEB. 16, 2007. Motions are in front of Judge. Gov't says atty. was day late in filing, she was there at 4:10 PM, notice on door said OPEN till 4:30. This is no problem. Judge must decide if claim is to remain in NORTHERN DISTRICT of N.Y., or transfer to WESTERN DISTRICT of N.Y. Will keep you uptodate on this matter. EHC 3

"WASHINGTON - The Bush adminerstration has ordered a nationwide review of medical research at 115 veterans hospitals and has halted some studies after investigators found serious violations of federal rules, including some that may have contributed to the deaths of patients." "The Department of Veterans Affairssaid it was investigating the deaths of patients in research projects at hospitals in Detroit; Albany, NY.; and Fargo, N.D. The department also said it had found "serious noncompliance" with federal rules at its hospitals in Pittsburg; Providence, RI.; Martinez, Calif.; and Long Beach Calif."

UPDATE: Gov't attorneys have until 12-15-06 to respond, they asked for 30 day delay. If you file FORM SF 95 for NEGLIGENCE/MALPRACTICE, submit a statement. If it comes down to going to court, submit to US Atty. REQUEST FOR ADMISSIONS. This means you submit questions to them forcing them to admit certain facts, example; is it true VA tested veteran 4 months in a row and they were all above 130 BS levels ? Yes or No. If you have proof, they must answer YES, and thats a big nail in their coffin. This ain't rocket science guys !! Just ask for help. Ed Crosby
