VA Civil Rights Form 10--0381 Offers Justice Potential|

The VA has a relatively new form
out in it's collection, only out since last year: VA Form 10-0381 to file discrimination complaints by reason of disability under the provisions of 38 CFR Part 15. The way to find the form is to go into the main VA website, www.VA.gov and click on the Find A VA Form on the right hand selection list. Once into the Forms page, just enter 10-0381 in the SEARCH blank and the form should come up and be fully printable on your printer. Veterans should complete read Part 15 in the VA Code of Federal Regulations before filing any forms against the statute. But without question, this new form really does offer justice possibilities to claims and corruption that so many Veterans have been forced to sit through. 38 CFR Part 15 does hold a short list of definitions and jurisdictions to be complied with whenever filing under this statute. This can be paired with the SF-95 Federal Tort Claims procedure, and it can be xeroxed and with sent copies to the Civil Rights Division at the Dept. of Justice. The 10-0381 Form does have to be filed either with the VA Secretary directly OR the Dispute Resolution Office also at the Washington VA office. Individual copies of the Code Of Federal Regulations can be purchased for around $60 a volume at www.gpo.gov at the on-line bookstore. There is enough fodder available right now, between the 2 Commission reports just recently submitted to Congress, to begin drafting civil rights claims based on the malpractices of the VA prior to any corrective pending legislation which is now on the move at Congress. Recommended targets for this new Civil Rights Form includes VARO and BVA judges; the VA Inspector General, the VA General Counsel -- both regional and at the Washington level; and any other internal destination at the VA who has refused to provide assistance to you and your disability case. Be as creative as you can be when filing these cases: you must show the ways in which you suffered discrimination by reason of your disabilities, but given the fact that the entire VA does not have a single friend in Washington right now, then this should not be very hard to do. Most libraries do have a copy of the CFR volume set, and if you can find it, you can xerox the entire Part 15 and take it home with you to read and prepare your case with. We are currently advocating at the BVA right now, to have them set up and launch their very own Judicial Misconduct process and leverage the existing Ombudsman oversight idea that they have now. But until we can get something better in place in the future, the Civil Rights Form 10-0381 should at least be the beginnings of an avenue for justice for all wronged Veterans to participate in. If you believe that you can put a case together on paper, Asel, then you should go through the steps of filing this VA Form per my instructions. The form is either filed directly with the VA Secretary in Washington or the Office of Dispute Resolution in the same HQ building. The VA Regional Office in Roanoke, Virginia discriminates against vets who do not fall into the category of minority veterans. The Office of the Inspector General promotes discrimination and abuse of veterans since they know there isn't anything we can do about it. Their staff are very racist and have also promoted abuse at the McGuire VAMC in Richmond.
Complaints filed by vets who are not of minority status will have their case closed fast. Their staff are very hostile toward non-minority veterans. |
