After passing through my own appeal
at the BVA Washington DC just prior to the Memorial Day holiday, it came to my attention as we started that the judge hearing my case, Robert E.P. Jones, had not read my case at all prior to the hearing nor did he possess any of my last minute fax filings where permitted under the Noticing letter for the hearing itself. He was basically showing up and reading only the last known VARO ruling in the case, without regard to what the issues really were, and with no up to the minute knowledge of what had been filed from the Veterans side of the case. To rescue from that situation, Veterans DO have to think on their feet and immediately enter something into the microphone so that the oral part of the hearing transcript shows that you DID make last minute paper filings by fax and that way it forces the BVA judge to include it in the final ruling. A complaint was issued shortly after I got back from that trip under our organizational banner to OUT the fact that the BVA was conducting appeals hearings without ever reading or knowing what the cases were prior to that point. You would want any judge to know the case before he or she arrives and starts the hearings so they can phrase relevant questions in an exacting way that probes the case. It also is a sign that they are just rubber-stamping whatever the VARO says, without regard to the HUGE difference that the BVA judge is a licensed attorney, whereas the VARO Raters are unqualified Slackers. By not reading the cases in advance of the docket, it tends to point to the idea that this is an important signal that they really ARE falsifying papers, not by the evidence and testimony of record, but just by taking any ole CRAP that the VARO Raters write, no matter how wrong or falsified they may be, and treating it as golden while the Veteran who is loaded with evidence to the contrary is ignored like he or she is not even in the room for their own hearing. We will keep you posted if we hear anything on the complaint that was filed, but News Flash: my congressional advocacy email list all received CC copies of it the day it was rammed into their faces. No ruling has been issued as of yet, and if he screws it up this time, then this failure to read the papers prior to the hearing minutes will be the very first strike of incompetence that I file to have him removed from the job. Veterans, be suspicious of them when you go through this process and notice every little detail about them and how they are conducting these procedings. Don't let them treat you like you don't exist while they SNORE through their own Slacker games. These are the small details which makes up for a bungled up and botched up ruling in your cases so don't let them skate on by with their nonsense to nowhere. BVA Washington DC: wake up, wake up!!
