I have previously posted on this site first in the Forum "Those Willing To Go The Extra Mile To Help" which was the wrong forum (but I don't know how to move it) and later in DIY in the "Lawyers" forum. McClellanVet gave some suggestions which I followed and have managed to get a lawfirm to talk to me about filing a possible lawsuit for malpractice/wrongful death. I have been in contact with a paralegal-I guess- at the firm of Rawls & McNelis, giving her info etc. Today she called and said that the lawyers want something from someone here (Ky) locally showing that I have the authority to file a claim. I faxed them the order from the Probate Court showing I am administratrix of my x-husbands estate (we were not legally married at the time of his passing in Nov 07) last week. Evidentally this is not sufficient.
MY QUESTIONS: According to VA law do I have authority to file a claim? Is there a particular form or document that I need to present? Should I ask someone from the VA- or would that be a stupid thing to do? The lady said even if our son filed the claim we would still need the proof of authority. Who can I turn to for help? |

If you were not married at the time of death, the only claim you can file for is for reimbursement for burial. You can't file a claim on behalf of your partner since you have no legal standing.
